By creating an account, accessing the NoFo application, or using a NoFo NFC puck, you are deemed to have read and agreed to the following terms and conditions.
1. Acceptance of Terms
By creating an account, accessing the NoFo application, or using a NoFo NFC puck, you agree to be bound by these Terms & Conditions (“Terms”).
If you are using NoFo within an organization, you confirm that your participation is voluntary and that your use of the service complies with your organization’s internal policies. If you do not agree to these Terms, you must not use the service.
2. Description of the Service
NoFo is a voluntary focus-support tool that combines a physical NFC puck and a digital application. The service enables users to initiate and track intentional focus sessions and to view their own focus activity over time.
Where NoFo is deployed within an organization, aggregated, non-identifiable engagement insights may be made available at group level. NoFo is not designed or operated as a productivity monitoring system, employee surveillance tool, or performance evaluation platform.
NoFo does not guarantee improvements in productivity, academic results, or workplace performance. The service is provided as a support tool for voluntary focus rituals.
3. User Accounts
To use NoFo, you may be required to create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to use the service in accordance with applicable laws and these Terms. NoFo reserves the right to suspend or terminate accounts in cases of misuse, violation of these Terms, or unlawful activity.
4. Acceptable Use
You agree not to use NoFo in any unlawful or abusive manner. This includes attempting to gain unauthorized access to the platform, interfering with its technical operation, reverse engineering the software, or using the service in a way that contradicts its intended purpose as a voluntary focus-support tool.
NoFo may restrict or terminate access if the service is used in a way that compromises security, functionality, or compliance with applicable law.
5. Organizational Use
Where NoFo is implemented within an organization, individual session data remains accessible only to the individual user through their personal account interface. Organizations may access aggregated, non-identifiable metrics at group level, such as overall participation rates or average focus time.
NoFo does not provide tools for individual behavioral monitoring, performance assessment, or disciplinary evaluation. The organization remains responsible for its own internal policies and communications regarding the use of the service.
6. Intellectual Property
The NoFo platform, including its software, application interface, branding, logos, visual identity, text, graphics, hardware concepts, and other related content, is owned by NoFo or is used under appropriate authorization where applicable. These materials are protected by applicable intellectual property and copyright laws.
These Terms grant you a limited, non-exclusive, non-transferable, and revocable right to use the NoFo service solely for its intended purpose. Except as expressly permitted by applicable law, you may not copy, reproduce, distribute, modify, reverse engineer, decompile, disassemble, create derivative works from, or otherwise exploit any part of the NoFo platform without our prior written permission.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
7. Service Availability
NoFo aims to maintain reliable and continuous access to the service. However, the service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation.
Temporary interruptions may occur due to maintenance, technical updates, security measures, or circumstances beyond our reasonable control.
8. Limitation of Liability
To the extent permitted by applicable law, NoFo shall not be liable for indirect, incidental, or consequential damages arising from the use of the service.
NoFo is not responsible for decisions made by users or organizations based on aggregated insights generated by the platform. The service is a voluntary focus-support tool and does not constitute professional, managerial, or performance advice.
Nothing in these Terms limits liability where such limitation is prohibited under mandatory law.
9. Data Protection
Personal data is processed in accordance with the NoFo Privacy Policy. By using the service, you acknowledge that you have read and understood the Privacy Policy.
10. Changes to the Terms
NoFo may update these Terms from time to time to reflect legal, technical, or operational changes. Updated versions will be made available within the application or on the website.
Continued use of the service after changes become effective constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and interpreted in accordance with Danish law.
Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the Danish courts.
The parties shall first seek to resolve any dispute through good faith discussions before commencing legal proceedings.
